Terms of Service

These Terms of Service ("Terms") govern your access to and use of the YourSend platform at yoursend.dev ("Service"), operated by YourSend ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding legal agreement to use the Service. By using YourSend, you represent that you meet these requirements and that all registration information you provide is accurate and current.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, including your API keys. You are responsible for all activity that occurs under your account. Notify us immediately at support@yoursend.dev if you suspect unauthorized access.

3. Acceptable Use

You agree to use YourSend only for lawful purposes. You must not use the Service to:
  • Send unsolicited bulk messages (spam) or messages without proper recipient consent
  • Violate the CAN-SPAM Act, TCPA, GDPR, or any other applicable messaging regulations
  • Transmit malicious content, phishing attempts, or malware
  • Harvest, scrape, or collect contact information without consent
  • Impersonate another person or entity
  • Interfere with or disrupt the Service or its infrastructure
  • Send messages that promote illegal activities, violence, or discrimination
  • Resell or redistribute the Service without our written consent
We reserve the right to suspend or terminate accounts that violate this policy, without notice or refund.

4. Messaging Compliance

As a messaging platform, you acknowledge that:
  • Email — messages are delivered via Amazon SES. You must comply with the AWS Acceptable Use Policy and all applicable email regulations including CAN-SPAM and GDPR.
  • SMS & Voice — messages are delivered via Telnyx. You must comply with the Telnyx Acceptable Use Policy, TCPA, and carrier requirements for A2P messaging.
  • You are solely responsible for obtaining proper consent from all message recipients.
  • You must honor all opt-out and unsubscribe requests promptly.

5. Billing and Payments

YourSend offers subscription plans with usage-based pricing. By subscribing to a paid plan, you agree to pay the applicable fees. Payments are processed by Stripe. Key billing terms:
  • Subscription fees are billed monthly in advance
  • Usage-based charges (email, SMS, voice) are metered and billed at the end of each billing cycle
  • All fees are non-refundable unless required by law
  • We may change pricing with 30 days' advance notice
  • Failure to pay may result in suspension or termination of your account

6. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by YourSend and protected by intellectual property laws. You retain ownership of all content you create or upload (templates, contacts, messages). By using the Service, you grant us a limited license to process your content solely to operate the Service.

7. API Usage

Access to the YourSend API is subject to rate limits and usage quotas as defined by your plan. You must not attempt to circumvent rate limits, reverse-engineer the API, or use the API in a manner that degrades performance for other users. API keys are confidential and must not be shared publicly or embedded in client-side code.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses caused by service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, YourSend shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that messages will be delivered successfully, as delivery depends on third-party carriers and providers.

11. Indemnification

You agree to indemnify and hold harmless YourSend and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

12. Termination

You may close your account at any time through the dashboard settings. We may suspend or terminate your access if you violate these Terms or engage in activity that harms the Service or other users. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

14. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.
